family

when a wife gets abuse by husband for a longtime, she decides to take their two children away to her relative in a different state to live on her own. Is it illegal? Does she needs the husband' consent?

Well your husband would probably report that as a kidnapping. He would have a right to pursue legal action to bring the children back. Your case is complex I would get advice from police agencies in your area and local attorneys.

Contact the police and ask about the local spousal support facility. Many of them have experienced attorneys to assist abused spouses. File for a domestic violence restraining order and at the same time request a court order allowing you to move out of the state for self protection.
