Legal Question in Family Law in California

Father Absent for over 3 years now wants partial custody - son is 4 years old no

I had a short relationship with a man and had his son. He disappeared when he found out I was pregnant. He later reappeared when our son was 3 1/2 years old. And only because he was ordered by the court to pay child support. Now he is threatening to sue for custody of my son out of what I feel is simply out of spite. Does he have any chance of taking my son? My son is close to five years old now and has seen his father probably 5-8 times only, and has hardly heard from his father via telephone calls. My ex has never been a father to his son. Should I be worried that a court would give him custody?

Based only on what you have told me, and assuming that you are ok as mom, don't worry, it'll never happen. If he says it again, laugh, tell him to go for it and tell him to get ready to pay for your attorney fees.

Leave out the laugh part, if he's a violent person.
