i want the father of my baby to appear on the baby's birthcertificate but hes not in the country and we are not marry and i think hes not going to be at the hospital when the baby is born?

The two of you can still complete the Voluntary Declaration of Paternity form and submit it to the state of California. If it is not sigined in the hospital by both of you and submitted by the hospital for you, you will not get his name on the original birth certificate, but once the form is submitted and processed, you can have the birth cirtificate revised to show he is the father.
