Legal Question in Family Law in California

my father won't let me see my little brother

Last christmas I went back home to Los Angeles from seattle to see my little brother (13 years old), who live with my dad. My dad did not even let me say hi to him. he just yelled at me from the other side of the door. we do not get along and most likely never will. My brother has severe autism and cannot speak for himself. My dad said the only way I will be able to see my brother again is if I go to court.

I would like to know what I can do in this situation and if i have any legal rights to see my brother. It just doesn't seem right for a father to split up siblings like that , especially when one can't speak for himself.

Thank you for your time and help.

Re: my father won't let me see my little brother

The only way that as a practical matter you can force your father to let you see your brother is with a court order, and although there is WA case law in the last few years that may support your continuing a relationship with your brother, if it is in his best interest, the burden would be on you to prove that, and I would not expect it to be easy. As to what CA law says on this, I don't know in any detail. You should seriously consider consulting with an attorney licensed in CA.
