How do I get the father to take care of his son?

My husband and I our non legal caregivers to our 11 year old nephew. We do not know where his mother is but his father lives in Georgia and has legal custody of our nephew. Our nephew is uncontrollable and we have little ones in the house. We want his father to take him back but are'nt sure how to go about it. His father does not seem to want him but after 2 years we can no longer keep him. Does his father have a legal obligation to come get his son? Do we have any legal recourse to reunite him with his father?

You can inform his father that if he does not pick him up or otherwies take custody of his son, that you will contac CPS in your community and tell them that you will not longer care for him. CPS will take custody of him and will bill father for the cost of providing care for him. There is a high probablilty that CPS will place him into a group home where he will lead a very structured life, and will receive counseling.
