Legal Question in Family Law in California
If the father of my child is asking for a paternity test and for the childs last name to be changed to his, who has to pay for the name change and paternity test and what is the cost?
1 Answer from Attorneys
Usually the cost of the paternity test is shared equally. If the father is found to be the biological father then he should probably pay. But if he asks for one and is found not to be the father then you should probably pay for half of the cost. As for the name change, that issue shouldn't be addressed until the paternity issue is complete.
or self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
