Can a father take custody away from a mother because she does not live in a good neighborhood and he does?

Custody is based on the childs best interests. Best interests also include the child's psychological relationship and attachments. If the only concern is that the neighborhood isn't as nice as yours, that alone would seem insufficient to trigger a change of custody if you elect to return to court.
