Legal Question in Family Law in California

father wants custody

I have moved back to the marital home to be with my 2 small children (3 & 1.5)My wife is a very controlling person and limited the time I was able to see the children, and it could only be at the home. It was tearing me apart, not seeing them. The marriage is not repairable. Now that I am back in the home with the children all the time, how do I proceed with custody? Can I move and take the boys with me. She is not an "unfit" mother, but uncaring and not loving to the boys. I respectfully request your advice.

Re: father wants custody

you can move and take the kids as long as there is not a court order forbidding it. Go ahead and move with the kids and immediately go to court asking for a restraining order giving you temporary custody.
