If you believe your sister is an appropriate caretaker for your child, you should file to allow your sister to be a temporary guardian for the child. A guardianship would allow her to be the parent for the child and she would be allowed to collect child support from you. You can speak to your local family law facilitator to determine if guardianship is something that you can do. If it is through consent, then it probably would not be a problem.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
