Legal Question in Family Law in California
father doesnt fel like he needs to give me child support
I went thru a paralegal to do the ''agreement'' and now he wants to fight me on it. he also doesnt think that he needs to give me child support since he cant keep a job. he works part time as a bouncer tho. is there anyway that i can garnish his wages? what are my other options with getting child support since i cant afford daycare on my own?

whether or not the father "feels" like paying child support, it is irrelevant. he has a legal duty that will be enforced by a mutual agreement or court ordered agreement, based on an earnings formula more or less. thus, the father here cannot "conveniently" pay or not pay child support in this instance. if you would like a free phone consultation regarding your rights and options here, email us directly with your contact information today.

There is a Family Support office in the county in which you live. Contact that office and request that they enforce the support order and seek more support. The court can and probably order him to seek full time employment. This service is free. The only draw back is that this office if often slow.

I suggest that yo contact the district attorney support enforcement bureau in the county in which you reside, and ask that them to begin enforcement proceedings on your behalf. The court can base support on his ability to earn full time wages as opposed to his actual earnings. The District Attorney will enforece your order and collect your child support at no cost to you. The only draw back is their service will be slow and impersonal.
If you can afford ot hire your own attorney, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
