Legal Question in Family Law in California

father is in jail

We are still married but my husband is in Jail and will be for the next few years but he refuses to sign my daughter's passport application because he does not want me to take her out of the country.

What can I do?

You can apply to the court for a court order allowing the court clerk to sign in your husband's place.
