if the father of my newborn wishes to give up all legal rights to our child what is my first step?

A person cannot give up their rights unless another person takes those rights upon themself. In other words, another man would have to be adopting your child, in order for the bio-father to give up his rights. Good luck!

Agreements between the parents to refrain from paying child support or other obligations are void under California law. Parental rights terminate by court order, such as in a dependency case, or an adoption.
