Legal Question in Family Law in California

Father refuses meds for teen

My 13 yo daughter suffers from depression and anxiety. She has been in counseling and counselor suggests meds. Made appt with psychiatrist who also suggests meds and wrote Rx. Ex and I have joint custody - 60/40 physical. Ex does not believe in meds and will not give to child. Wants her to use cognitive therapy which child refuses and will NOT work if she does not cooperate. Depression runs in family, child needs the meds. If I give them anyway, does ex have any legal recourse regarding custody? Can I get a court order to require him to give her the meds as prescribed by a physician?

Thanks,

BB

While it will take more work and money the best way to handle this situation is to get the court to make an order concerning the medications. You can give her the meds, but better talk to the Dr. about what happens if she does not get those medications consistently. You will need a letter from the Dr. concerning her need for the meds.
