Legal Question in Family Law in California

father wants summer child support

To whom it may concern:

The father of my child is scheduled to have our child for half the summer. He has called and told me to give him the child support checks that I will be receiving during that month (from the D.A.) since the child will be living with him. Is he right? I thought the child support was already calculated by the D.A. and that they have considered that he will be having the child during half the summer (he gets him approximately 20-30%) for the whole year. Thank you for any help you can give.

In California child support calculations take into consideration the amount of time the child is with the payor parent.

You do not have to give him the child support checks. The only exception to this rule would be if the court order provided that he did not have to pay child support when the child is with him during the summer. Under the current California law that could occur only by stipulation.
