Legal Question in Family Law in California
Father going throught trail for murder does he have rights to his child?
My best friends ex is in jail right now going through trial for murder. My friend wants to get full custody and move far away. She went to file papers for custody and they said that he still has a right to take her to court to fight it. Is this right?

Yes. He still has the right to notice and an opportunity to be heard. As long as he remains incarcerated, however, he obviously can't have physical custody. Contact an experienced Family Law attorney in the county where the child resides for specific advice and possible representation on your behalf.
