Legal Question in Family Law in California
father's comments to children
My children's father & I have joint custody. ( child's ages-10 & 12). My kids often tell me of things that their father has said , like, ''your mom is a B****,huh? or, your mom is ugly, huh? most recently they told me that he said, ''There is gonna be a weekend pretty soon when I'm not gonna take you back.'' My kids are scared to go over there now. Afraid of him not bringing them back

Re: father's comments to children
Filing a motion to change custody or visitation is not likely to be successful. You should consider taking the children for counseling. If they tell the counselor and it does not appear to be something they were coached in saying, it will increase the probability of success of a motion to change visitation. In the mean time you could volunteer to pickup the children after the visits. This should give the children a greater feeling that they will not be returned home.
