Legal Question in Family Law in California
Fathers Right to custody
My ex wife has a new boyfriend that has an extreme violent history. He has not only beat her black and blue but has hit my 5 years old daughter in the face. When I called CPS they didn't want to do anything about it, but finally went out to investigate. Because the boyfriend was no where around and my ex threatened my children nothing could be found, beause the children lied about what happened. He went to jai for beating my ex but now is back and is staying with her. I am worried for my childrens saftey and the court isn't listening, what can I do? Please advise.

Go to Court and obtain custody of your children based upon the facts you articulated!! If you are in SoCal call me for a free telephone consult at 818-98-1584

Which court is not listening? You haven't mentioned going to court and CPS is not court. File your motion to change custody or at least child sharing. The burden of proof in a family law court is much lower than the burden in criminal court or the standard that CPS uses. Start now, any delay only indicates to the court a lack of interest or that your concerns are not well founded. Good Luck, Pat McCrary
