Legal Question in Family Law in California

Father's rights

When a father advises his wife that he would like a divorce, but no legal representation has been obtained yet, does the wife have the right legally to forbid said father to see their child without her permission and limit the amount of time he can spend with said child or to forbid him to drive the child anywhere in his vehicle?

Re: Father's rights

No, she has no rights whatsoever without a court order. Also what she's doing is not legal, realistically there isn't anything you can do about it without going into court in getting a custody order. I would suggest doing that as soon as possible.

Re: Father's rights

Certainly not. It seems however, you are poised for a fight. You would be well served by obtaining representatiion before the cards are stacked up against you and you get less than reasonable visitation and stuck with higher child support payments that you may wish to provide.
