Father's rights as a parent

My boyfriend had a little girl as the result of a 1 night stand. The mother refuses to let him take the child out of her home or on his own without her being there. He doesn't want to take her to court because he was told he could not get joint custody until the child is 2. In addtion, he heard he would have to pay 25% of his income a month in child support because the mother doesn't work. What can he do to avoid paying 25% of his monthly income in child support and be able to take the child on his own without the mother? THe little girl will be 1 in sept.

If mother is on welfare the county has or will be filing a paternity suit against him and requesting that he pay child support. Assuming that he is the father he will have to pay child support until the child is 18 years old or 19 if the child is a full time high school student. A major factor in setting support is the per cent of time that the child is with dad. The more time the child is with him the lower his support will be. If he wants more contact with the child he should file a paternity suit and request a visitation order.
