Father's Rights

I'm an unwed mother who recently had a baby, the father wants to be active in the child's life and is named as the father on the birth certificate. I attend law school in New Orleans but my permanent address is in CA where the baby was born and is currently living. The father is currently residing in New York. I have one more year left of law school and my family is advising me not to take the child with me to New Orleans. Were I to do so, could the father petition for primary custody? He has offered to move to New Orleans to help out with the baby and I want to know what his legal options are were I to turn down the offer. Thank you!

The father has the same rights whether he lives in New Orleans or some other place. Leaving your baby with your parents could be risky. Unless your parents have been appointed guardians of your baby father may come and claim his right to custody, which would be superior to your parents claim.
