Legal Question in Family Law in California

father's time allocated with children

Judges decision on custody for our 2 daughters for me is from after school(3:00P.M)till 6:00 weekdays and every other wknd.I'm also to pay their mom 880+1/2 tuition (275)and she is to get the checks from S.S.from my disability to the children(325 ea)per month.

Ex was ordered to move out of my separate property duplex as we all have been living together at my expense thru the whole process( she has not)I have not worked for the last 4 yrs due to an injury for which I started getting S.S. Disability about 4 mo. ago,I also got 28,000 from retroactive pymts.I get 1200+rental income of 1575p/m.She shows 3000 mo.income

I have refinance my property 2x in the last 2yrs. to make ends meet since she doesn't help with expenses other than i/2 tuition and whatever she wants to get our girls ages 11&14.

Since she is been working full time from about 6 mo. ago,I'm the one that cooks, picks up the girls from school takes them to soccer practice and is able to help them with their homework andI'm available 24/7.I do not agree with the judges decision. When I told my 14 yr. old of my time allocated with them she was not happy and express willingness to speak up( she said she wants 50/50).

How should I proceed on trying to modify this?

Re: father's time allocated with children

Anytime there is a change in life circumstances that impacts the lives of the children and/or custodial parents at issue, an OSC hearing would be the proper route to take to show cause why a past court order is no longer viable or fair. Necessary modifications can be legally court ordered at the OSC hearing. If you would like complete, affordable assistance in this matter, contact us today.
