Legal Question in Family Law in California

Ive had a feeling for months that he is having an affair,the other day he said he wants a divorce which ive been wanting as well,i found evidence that he has been having an affair,text messages and he has been contacting her since april,and we just bought a house. He is saying he wants to be fair to me and he wants to file online so its the cheapest way for him and he doesnt want me to get a lawyer.

Not sure what he means by filing on line. My guess is that he wants to complete the forms on line and then file them with the court... He cannot control whether or not you have an attorney. I will suggest that you ought to have an attorney to review paperwork and ensure that the divorce is fair to you. The filing fee is the same whether or not documents are filed by fax. Not sure which court he is using, as I have never heard of filing "online." Documents are still filed with a court to initiate a divorce. You always have the right to consult a lawyer, even if you do not want to hire one and incur a great deal of expenses.
