Legal Question in Family Law in California

feloney in domestic violence case

hi, this is what happened, my husband beat me with a belt and stormed out of the house. I called the police and told them what happened. they took the belt for evidence. he went and turned himself in, put in jail. I bailed him out 2 days later. his charge is felony in domestic violence. he has no proirs what so ever, not even trafic violation. how will they treat his case, can it be droped? I want to help him, I dont want him to go to jail, I am staying with him. he is the only provider in this family. what can i do to have this filed as a misdemeanor rathar than a feloney, and get the minimum. we both are very scared of what they might charge him with and if he goes to jail for a long period of time we are going to lose our home. the D A office have not filed formal charges yet, and I cant get any info anywhere. how do these things work. I need to understand this whole process and how it works.

Re: feloney in domestic violence case

First both of you should get some help in dealing with this physical abuse. Do it now. Don't wait. It's the best way to deal with this situation at this point.

Second, don't tolerate the abuse. These things tend to get worse. If he's truly sorry he will jump at the chance to get help.

Nobody wants to break up your family, they want to prevent serious injury.
