Legal Question in Family Law in California

My fianc� got divorced in 2010. Now 4 years later his ex wife is wanting more money in child support. She has gone on her own to a paralegal and is using his 2008 W2 to calculate and it is coming up almost double what he pays now. Can she use his W2 for calculate or is it the latest W2 that must be used?

You don't use the W-2 at all. You use the two years most recent tax returns and the two most recent pay stubs. If there is a meaningful difference the court must decide what most accurately represents the parties annualized income at the time of the decision.
