Legal Question in Family Law in California

My fiance and I would like to apply for domestic partners in San Francisco, CA prior to the 3rd party personal injury lawsuit being completed. The other party is countersuing. Since I own my home as a single female, I would like to know if the other party can attach a garnishment on the house if they are successful? If so what recourse can I do to protect myself? Should I get a Prenuptial or Postnuptial?
