Legal Question in Family Law in California

My fiance has a daughter with his ex girlfriend. He helped raise her and he got into some trouble and served his time for nine months. In those nine months his family offered her to stay with them for free so they could help her. But then she took off to another state with no legal documents or his consent to do that. By law is she aloud to do that?

There are too many "ifs" in this situation to answer it. For starters, if he never got a court order for paternity and they didn't sign the declaration of paternity form in the hospital, he has no rights. If there was never a custody order, she was allowed. There are lots of other factors that require review to give a valid answer.
