Legal Question in Family Law in California

Fiances ex wife to be won't leave guest house

My fiance and his wife own a home together, they are in the process of a divorce. She still lives at the property, only in the guest house. I live with him and take care of his children, she gave him complete custody of them. She causes us stress and grief EVERY DAY, and it's not getting better, it's getting worse. She calls the police on us almost everyday for nothing, just to mess with us. The police say that we can't do anything about this, but there has to be something that can be done to get her to leave and get out of our lives. She doesn't want the kids then there is no reason for her to call everyday and harrass us. Please help, she is making both of our lives miserable, and we're at wits end. We really need help!!!!

In a general sense, it sounds like your fiance needs more structure and boundaries as part of the divorce process. Your fiance shoudl discuss this with his attorney.

He may be able to obtain a domestic violence restraining order against her. Her conduct can be restrained. Such an order could prohibit her calling him, his home or the children, except when allowed by court order. Getting her removed from the guest house may be more difficult. He should consult with his attorney or retain an attorney to deal with this matter.

Re: Fiances ex wife to be won't leave guest house

Your fiance needs to call a lawyer ASAP! I have done family law for years and this sounds like one of those situations that can spiral out of control. What really concerns me is that one of those phone calls to the police could result in your fiance, and/or you being arrested and taken to jail, or even worse being prosecuted criminally for something!!

You or your fiance may call me for a free consultation over the phone. I have handled many situations like this before. 818.427.6246 ext. 10
