what should I have when fighting an open case with child services in court to retain custody and parental rights have been wrongfully stripped of both pending trial.

If Child Protective Services has filed a dependency petition, that dependency petition has priority and superior jurisdiction to any family law matter that you have pending with your ex. The court appoints an attorney to represent the parent, and you need to speak to your dependency attorney about your rights and duties.
