Legal Question in Family Law in California
If I file for a Legal Separation, and then a divorce, does the time spent in the separation count towards the waiting period for the divorce?

What you would be doing in that senario is converting your pending legal separation action into a divorce. This approach also avoids a new filing fee.

I agree with Ms. Kock, but the only reason that I can think of to do it that way is because you don't yet have the residency requirement for a dissolution. If you have the residency requirement now, you should go ahead and just proceed with dissolution.
