No, a dissolution can be filed a any time.

The five year rule is for "summary" dissolution. Summary dissolution is a simplified procedure for married parties or domestic partners to get divorced. If you have been married for more than 5 years, or have other disqualifying factors such as children, you have to file a regular dissolution.
