Legal Question in Family Law in California
If I file for an Order Shortening Time how soon after will the hearing usually be scheduled for?
If there is already a petition pending with a mediation hearing in late December, and I ask for this Order Shortening Time do I need to have already responded to the petitioner with my Response Declaration and Financial Worksheet first? I have not done this yet since the current hearing is so far away and I am trying to put together all my documentation.

You should check with the court clerk in the court where you will be filing the request for the OST. Local policy, local resources, and the ebb and flow of demand for hearing times all affect how soon they can hear a matter. Check with your Family Law Facilitator or Self Help office for the details of what you have to file with the request for the OST and what you have to file and serve before the hearing.
It would appear that you are in San Diego County. The hearing schedule is greatly backed up and a December mediation date is normal. You would not request an order shortening time but an request to advance the hearing date. That is unlikely to be granted. If there is a disagreement over child sharing you can ask the court to set a temporary child sharing schedule. Some judges will do that, others will not. The same with issues of child and spousal support. It is difficult giving you advice without knowing all of the facts. You may call my office for a free 15 minute consultation. Tell my office that I offered you this on Lawguru otherwise they will ask for a consultation fee.
