Legal Question in Family Law in California

When to file?

My wife and I are moving seperately back to CA. It appears that reconciling our marriage is not possible. Is there a period of time we must wait before we can file for divorce?--- Can one of us file without the other one in the state yet?

Re: When to file?

You can file for legal separation and then after six months amend that to a petition for dissolution. That way you can begin the six month waiting period. Good Luck, Pat McCrary
