Legal Question in Family Law in California

I Don't Know What to Do!

I filed for custody of my children in the county that we live in. My ex knew that I filed, I told him the mediation and court dates, but was unable to serve him because he would disappear. He ended up filing also, in another county, suing me for custody. I was served and the next day, went to an attorneys office. Neither myself nor the paralegal could find a court date. The paralegal did some searching and found out that the hearing was that morning and I had missed it because I did not know. Since I did not show up, my ex was awarded custody and I had to hand him my kids today and the sherriff said that if I did not, I could be arrested. What do I do now?? Please help!

You need to file a motion to set aside the order from the other court. It hasn't worked well with a paralegal so far, so maybe you should try hiring an attorney. Good Luck, Pat McCrary
