Legal Question in Family Law in California
Hi My ex filed for a divorce in April 08 and I did everything I was told to do because I wanted the divorce too, she called me in April 09 and said that we were still married because she forgot to turn in a paper, I signed the second part and went today to see if I am divorce because I am getting married Oct 2010 and she still has not filed her part of the paperwork but the lady at the court I talked to said that it wasn't on me I did everything but my ex hasn't done her part, what do I do, I live in California and really need this divorce to happen fast, Can you please help me?

The good news is that you actually have plenty of time if you get things moving now. The bad news is that without knowing what paperwork you and your ex did file and what is missing from what your ex was supposed to file, it's impossible to help you straighten it out. One option is to pick up a copy of "How to Do Your Own Divorce in California." Before I started practicing Family Law, I used it for my own divorce because, even as an experienced attorney, it made more sense and was easier to figure out than the law books on the subject. If you follow their step by step instructions, and note what has been done and not done, and then follow their instructions for getting a divorce finalized, you can probably get things wrapped up. Even without your spouse's cooperation you can get the divorce finalized. The other option is to call or email me or another Family Law attorney for a free consultation.
