Legal Question in Family Law in California

I have not filed for a divorce yet but me nd my son do not live with my husband my sons father anymore. I dont trust to leave my son wit him or to even hand him over for him to hold him. I fear that he will not give him back. What are the laws on child custody? Do i have to let him see our son before i get a custody agreement from court?
