Legal Question in Family Law in California

i have filed for divorce, at the time my spouse complained that he did not hav the funds to move out of the home, so I decided to move, although in the marital settlement agreement it states that me and the kids are to stay at the house, I want to move back but want him out. can I move back and file a cout order for him to move out or is it too late since I have already moved? in addition, his income has increased so he can afford to move.
