Legal Question in Family Law in California

I filed for divorce and waiver of fees in 2006. months later i received a notice that my fee waiver was not accepted. Now, in 2013, can I refile the same case file as I did in 2006?

Not likely. The Petition was probably dismissed once the fee waiver was denied. If it was dismissed, you would have to start a brand new court case.

I agree with Ms. Bridgford. You are not clear on what the status of the first filing was once the fee waiver was rejected.

If the original petition was not dismissed, you may be able to proceed after paying the filing fee. Please contact the clerk to determine the status of the 2006 filing.
