There are never things like percentages in family law. Nobody can predict what a judge would award. However with that being said, if you filed an ex parte motion and the judge essentially referred you to mediation, that leads me to believe the judge was not convinced that a serious harm had occurred. Typically they would take larger emergency measures if they feel a harm is going to happen to a child. You should speak with a local attorney to assist you in preparing your side for the next few court dates.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
