Legal Question in Family Law in California

Filing a contempt of court order via ex-parte in a child visitation case:

The children�s mother has not followed our court agreement on my visiting with the children. She has been in KY for 2 years and is now moving back to CA (where I reside). She has since reconfirmed she will not follow our latest court agreement for visitation;

Time is of the essence and the kids miss me dearly. Is the fact the children�s mother not following the court order and keeping the children from me, reason enough to file ex-parte?

You may file ex-parte, but unless the welfare of the children is in question, it most likely will not be granted. Regardless, contempt is not filed ex-parte, but just regarding custody and visitation. You really need to speak with a local attorney who specializes in family law matters. Good luck!
