Filing for Custody in another City/County

Can I file for custody in Fresno County after opening a case in Imperial County. The case in Imperial County was put on hold due to the other party losing our children to C.P.S. The case with Social Services has ended and now I want to bring this case up to Fresno. Even though I started in Imperial County can I move my case to Fresno by filing for custody in Fresno since neither party has legal custody.

When multiple cases are filed one of them is dismissed. The case that is filed last is usually the case that is dismissed. The proper procedure is to make motion for a change of venue.

If the other party still resides in Imperial county, it is unlikely that you will be allowed to move the case to Fresno County.
