Filing for Divorce in California

This question is sort of weird but I was told that in the state of California you cannot file for a divorce if you are living with another person is this true?? For instance I am worried about my mother in law, she is living with a man that is not yet divorced, from his ex wife, now supposedly he cannot file for a divorce since he is living with her and now is moving her back to Minnesota for 1-2 years until he can get this divorce. I think it is pretty fishy and worried he is telling her a lie?? Could you hel me please??

California is a no-fault state, which means adultery or cohabitation would not be a defense or a bar to obtaining a divorce.
