Filing for divorce

If I have lived out of state (CA) for more than a year and my husband has lived there for many years and still does, can I file for a divorce in CA?

You cannot, spouse can. Must be resident for six months prior to filing.

No, you can not file a petition for dissolution of marrige of you are not a resident of the State of California for the past 6 months continually. Your resident spouse can file, and then you can file responsive pleadings.
