Legal Question in Family Law in California

filing a motion to be removed

Can your own lawyer file a motion to be removed from your case, because you can't pay a bill in full & need to make payments, after you have already given over fifteen thousand dollars? Is that considered abondoning a client?

Re: filing a motion to be removed

A lawyer can do such a thing, and the judge will evaluate the merits of the motion. If the case is not close to trial and the client will not be prejudiced, the attorney can be removed. Your rights would not be served by a disgruntled attorney who is not being paid.

Please contact a qualified attorney before you take any action.

Good luck,
