Legal Question in Family Law in California

After filing, how soon after can I move out with my children?

I want to move out of our rental home and move on since I have filed. When am I legally allowed to move out with my children. I am financially unable to stay in the home we are in , and it is not fair tho my children to live in such a tense environment.

Re: After filing, how soon after can I move out with my children?

The time that you can move out would depend upon the circumstances of the house. If there is a lease you would have to consider the cost of moving out. If the house is one you are purchasing then one of you should stay in the house until it is sold. You can move out any time if your spouse will be remaining behind in the house. You should consult with an attorney about the circumstances and your options. As you can see from the above your best option will depend upon facts which you have not put in your question.
