Legal Question in Family Law in California

Filing Papers?

Hello! My divorce was final in Aug of 2004. In that divorce agreement there was an agreement between my ex and I of how much money he was to pay back to me for joint bills that were under my name. At this time he still owes me $1,500 or around there, but he should have been completed with paying me in March.

He doesnt answer when I call and he doesnt return my calls! He used to live with his parents but I'm not sure if he does anymore. When I go back to court I'll have to file more papers and more then likely have them sent to him. Can they be sent to the same address I was sending them to before? Or will I have to have a new address? Is there any way of collecting this money other then going back to the same judge? Thanks so much!

Re: Filing Papers?

You can have a writ of execution issued without a hearing and without notice to him. It is done by the clerk, not a judge. With that writ of execution you can attach his wages or any financial accounts that he has. You are also entitled to attorney's fees. Good Luck, Pat McCrary
