Legal Question in Family Law in California

Filing a QDRO with PERS in CA

In my CA Div Agreement there is a QDRO for 7 years of my Ex pension. I need to get a copy of that on file with PERS so they open an account in my name so when he retires, I get what I am due. I have very limited funds as I am not getting any alimony yet and have only gotten 4 child support payments(ex is currently on disability). Can I send a copy of the QDRO myself or must I use an attorney? I just can't afford the $495 I see advertised. I am currently residing in NV and it needs to be filed with them in CA.

Re: Filing a QDRO with PERS in CA

You need to get a QDRO on file. If he should die before the QDRO is put in place you could lose out on these benefits even though your decree provides for you to receive them. QDRO's are very difficult documents to prepare. Save the money or borrow the money to have an expert prepare the QDRO for you and do it sooner vs. later.

If there is a QRDO then the PERS would have already been joined. I do not believe that is the case. Contact me directly. Who advertises for that fee?
