How Much Filing Time Is Necessary?

I have been offered employment in my homestate. The salary is slightly more than I make now, but cost of living there is much less. How much time is necessary to file a stipulation requesting that I be allowed to relocate? The school year in the new state starts mid-August. Other factors that affect this case are: The move will place me near supportive family (my father is offering to help our family financially) continuing domestic violence and a large arreage due in child support, and refusal to comply with court orders that require him to pay for part of childcare and health related expenses. Two months seems like short notice even to me, but can it realistically be done? Father will probably object.

Ms Simmons response was well thought out and may well be successful. He may be willing to agree is there is a reduction in his child support arrears. Also you may want to think about suggesting a hi speed internet connection in the home of each parent. An internet camera would allow father and son to see each other on a daily basis. The cost of the internet connection in each home would be the responsibility of that parent.

A stipulation can be signed and submitted in a day but you are saying Father will object. If you assume he will object you have to file a motion at once in order to get a hearing date in August. Then the court may well continue the decision until some sort of evaluation and/or longer hearing with witnesses is held. In the end you will probably get permission to move. You would be better off getting him to agree to sign a stipulation. Since he has arrears I assume money is an issue for him. Offer to pay all the transportation costs for 2 visits/year and lower the support below guidelines. You may also forgive some or all of the arrear if there was no welfare involved. You may want an attorney to help you prepare your motion since you want this to move as quickly as possible.
