Legal Question in Family Law in California

I am a Filipinoa/American citizen, I have a 20 month old daughter with my filipino boyfriend. She was born in the US and the father acknowledged and she carries his last name. How can I file for child support in legal means. He currently supports but I need something in writing just in case he drops dead and no will was established. How much is your retainer if ever we do have a case.

You should contact your local department of child support to open a case with them. They will assist you in getting a case open and start to collect child support for you. If the father will leave the country it will be very difficult if not impossible to get child support from him. Many countries do not have reciprocal agreements with the US in regards to child support orders.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
