Legal Question in Family Law in California

Financial Obligation to College Funding

I am divorced. The ex and our son live in San Diego County, CA. I live in Washington State. Our son is now 19 and is attending college. If I give him money towards college, would this make me liable for him furthering his education?

Re: Financial Obligation to College Funding

It depends on what your order of child support says, and as he's nineteen, it is too late to change it.

Some orders say the right to petition for post-secondary is reserved; some say post secondary will be provided, some say obligation stops at age 18 or graduation from high school, whichever comes last.

See what yours says.

If there is no obligation to assist with post secondary, then you cannot incur liability by helping with college.

If there is a post secondary obligation, then that is enforceable.

Your question is a little hard to understand - I hope this helps. Powell
