Legal Question in Family Law in California
Financial responsibility
Dear Sirs
Althought my son was never married,he fathered a son with his x girlfriend. His son is now 6 yrs old. They share joint custody with her percentage slightly more 60/40.She has recently married and since had a baby.It seems she now is trying to get more money out of him.Her attorney has asked my son and his wife to devulge their financial status including all purchases. Her attorney has also requested information from his employer dating back to 2003.They already have a court aggreement for child support and custody.
#1 Can her attorney request information on my sons wifes finances. As they were married after said court aggreement
#2 Can my son request financial information on his X girlfriend and her spouse.
#3 who is responsible for the cost of all these financial requests.
#4 Does his X have the right to change custody status for no apparent reason.Other than to get more money because she now has more personal debt.
This action was filed by the X girlfriend in an attemt to extort more money out of my son I believe. My son was satisfied with the current custody and is tired of her constant harrsasment. My son is an excellant father and does not deserve this treatment.
thanks L.

Re: Financial responsibility
you have quite a few questions that would most time effectively be answered thru a free consultation with an attorney. however, in a nutshell, your son is NOT legally obligated to disclose ANYTHING that the opposition is requesting without a Court order showing cause, or pending discovery. if you would like further legal assistance or direction, contact us today for a free consultation and evaluation of your son's rights. he sounds like a great father.

Child support in California is calculated by using an state approved computer program. The new spouse income is used soley for the purpose of determining the amount of taxes paid by the parent. Each parent has the right to obtain pertinent financial information from the other party. The requesting party pays the cost of producing the requested documents. Unless there is a court order for visitation she can change visitation. You should retain an attorney to review his case with him and discuss his options.
